Terms and conditions

1. Acceptance

   By accessing, visiting or using our premises (the "Premises"), you ("You" or "User") agree to be bound by these Terms and Conditions.

2. Definition of Member

   For the purpose of these Terms and Conditions, a "Member" shall mean any individual who has been accepted as such by The Colony Club Casino in accordance with clause 3 below.

3. Membership Application

   To apply for membership, you must complete an application form provided by us at our discretion and provide all required documentation to establish your identity and address.

4. Acceptance of Membership Terms

   By accepting membership, You agree to comply with these Terms and Conditions as well as any rules or regulations made from time to time which are displayed on the Premises.

5. Conduct on the Premises

You must at all times act in a manner that does not breach these Terms and Conditions, is consistent with the Club's good name and reputation, and complies with applicable laws and regulations.

6. Admission Policy

   We reserve the right to refuse admission or eject any person from our premises if we reasonably believe they are likely to behave disruptively, cause damage, create disturbance or be otherwise objectionable.

7. Dress Code

A dress code will apply at all times while on the Premises and you agree to comply with it in accordance with clauses 1-10 of the Dress Code Policy displayed on the Premises.

8. Equipment and Materials

   The equipment and materials provided by us for gaming, dining or other purposes shall be used only as intended and shall not be damaged, altered, modified or removed from our premises without prior written consent from management.

9. Liability

We accept no responsibility for any losses or damages resulting from:

a) the cancellation of games or services;

b) acts of God; natural disasters; civil unrest; terrorism; war or similar events beyond our reasonable control;

c) your failure to comply with these Terms and Conditions, gaming rules or regulations;

d) the negligence or misconduct of you or other Members.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with English law. Any disputes arising hereunder shall be resolved by arbitration conducted in accordance with the rules of the Chartered Institute of Arbitrators.

11. Amendments to these Terms and Conditions

    We may, at any time without prior notice to you, make changes to or update these Terms and Conditions. Continued use of our Premises after such amendments will constitute acceptance of those amendments.

12. Termination

a) We may terminate your membership with immediate effect if we reasonably believe that:

i) you have breached any material term under these Terms and Conditions;

ii) your continued membership would compromise the Club's good name or reputation; or

iii) there are no longer grounds for continuing your membership.

b) Upon termination, you agree to return all property of ours in your possession and immediately cease using our premises.

13. Entire Agreement

These Terms and Conditions constitute the entire agreement between us and supersede any prior agreements or understanding whether written or oral relating to these matters.

14. Waiver

    The failure by a party to enforce at any time any right conferred on them in these Terms and Conditions shall not be deemed to be a waiver of that right.

15. Dispute Resolution

In the event of any dispute arising from these Terms and Conditions, we may resolve it through mediation or arbitration conducted in accordance with the rules of the Chartered Institute of Arbitrators.

16. Rights Reserved

    The exercise by us of any one of our rights under these Terms and Conditions does not prevent its being exercised at the same time as another right so provided for.

17. Service Charges

We may from time to time impose service charges on Members for certain services, including but not limited to food or beverages consumed while using premises.

18. Photography and Recording

a) By entering our Premises you consent to being recorded or photographed by us, or at our discretion any third party appointed by us.

b) We may use such recordings or photographs solely for internal business purposes (including advertising and marketing), subject always to compliance with relevant laws relating to the taking and retention of personal data.

19. Severability

If any provision of these Terms and Conditions is declared void or unenforceable in whole or part, then that declaration shall not affect other parts of these provisions which shall remain valid and binding upon us and You as if such invalid or unenforceable provision had been severed from them.

20. Definition of "We"

In these Terms and Conditions, the term 'we' includes The Colony Club Casino (or its assigns) including without limitation any member(s), officers, employees, agents and contractors for whom it may be responsible and whose acts are deemed to be that of The Colony Club Casino.
